CANCELLATION POLICY
Cancellations must be requested by the reservation holder by email to:

Apartment and Holiday House bookings
Cancellation up to 15 days before the arrival date: refund of the amount paid, deducting €25 as administration fees.
Cancellation less than 15 days before arrival: the amount paid as a deposit will be retained as cancellation fees.
Villa bookings
Cancellation up to 30 days before the arrival date: refund of the amount paid, deducting €35 as administration fees.
Cancellation less than 30 days before arrival: the amount paid as a deposit will be retained as cancellation fees.
If a refund applies, the amount will be reimbursed within a maximum period of 14 days.
BOOKING MODIFICATION
A booking modification may be requested up to 30 days before arrival, provided that the modification is possible and approved by PARC MONT-ROIG.

A supplement of €25 will apply as an administration fee.
Modifications are subject to availability and, where applicable, to the corresponding price adjustment according to the rates in force at the time of the modification.
CHECK-IN AND KEY COLLECTION
Online check-in
Online check-in must be completed by providing the details of all occupants of the accommodation up to 1 day before the arrival date, through the link provided in the booking confirmation email.

If arrival is after 19:00, you must contact our office in advance in order to arrange key collection via a security box with code, located next to the office door.
Key collection outside the established opening hours must be previously authorised by PARC MONT-ROIG and may incur a supplement of up to €50.
Remaining payment
The remaining balance of the booking must be paid on the day of arrival at our office by credit card or cash.
SECURITY DEPOSIT
PARC MONT-ROIG may request a security deposit by means of a pre-authorisation on a valid credit card, in order to cover any possible damage, breaches of the stay conditions or additional costs attributable to the guest during the stay.
After the guest’s departure, and once the condition of the accommodation has been checked, the pre-authorisation will be released, unless its total or partial execution is required for the aforementioned reasons.

RULES OF CONDUCT IN THE ACCOMMODATION
The reservation holder shall be responsible for compliance with these rules by all occupants of the accommodation and shall be liable for any damage caused during the stay, which must be reported immediately to PARC MONT-ROIG.
Guests must:
• avoid making noise that may disturb neighbours, especially during rest hours
• respect the rules for the use of swimming pools, gardens and common areas
• deposit rubbish in plastic bags in the municipal containers located in the street
• not leave bicycles, prams or other objects in common areas
Water and electricity must be used responsibly and in accordance with normal use of the accommodation.
Guests undertake to keep doors and windows closed when the air conditioning is in operation and to switch it off when leaving the property, thus avoiding excessive consumption.
Minors must remain under the supervision and responsibility of an adult at all times.
Occupancy exceeding the maximum capacity stated in the booking shall not be allowed, unless expressly authorised by PARC MONT-ROIG.
The internal regulations of the accommodation, as well as the rules of the owners’ community, are mandatory.
Failure to comply with these rules may result in the total or partial retention of the security deposit and, in serious cases, immediate eviction from the accommodation, in accordance with Article 39 bis of Catalonia Tourism Law 13/2002.
YOUNG GROUPS
Bookings for groups of young people under 25 years of age are not accepted.
INCLUDED SERVICES
The booking includes the delivery of the reserved accommodation for temporary use for holiday, tourist or recreational purposes during the contracted period, as well as the services indicated in the booking confirmation.
The property is delivered furnished, equipped for everyday use and in suitable conditions of cleanliness, maintenance and proper functioning.
Water, gas and electricity supplies are included. Electricity consumption is included up to a maximum of 210 kWh per week, equivalent to 30 kWh per day. Consumption exceeding this limit will be charged at €0.40 per kWh.
PETS
Pets will only be admitted subject to prior notification and acceptance by us.
A supplement of €5 per pet per day will apply, with a maximum of €105 per stay.
TOURIST TAX
In accordance with the regulations in force of the Government of Catalonia, the Tourist Tax will be applied according to the legal rate in force.
At present, the applicable amount is: €1.93 per person per day, with a maximum of 7 days per stay. Minors under 16 years of age are exempt.
This tax must be paid directly at our office on the day of arrival.
CANCELLATION OR ALTERNATIVE ACCOMMODATION BY THE AGENCY
In the event of a supervening impossibility of making the reserved accommodation available to the guest for reasons not attributable to the guest, PARC MONT-ROIG may offer alternative accommodation of similar characteristics. If this is not possible, a full refund of the amounts paid will be made.
CLAIMS AND INCIDENTS
If any deficiency or incident is detected in the accommodation, the guest must report it immediately during the stay by email to:

PARC MONT-ROIG will make every effort to resolve any incident as quickly as possible.
In order to be properly dealt with, incidents must be reported during the stay and as soon as they are detected. Subsequent claims regarding incidents not reported during the stay will not be considered, unless by their nature they could not reasonably have been detected at that time.
LIABILITY
PARC MONT-ROIG shall not be liable for incidents, negligence or services attributable to third parties, nor for force majeure situations or unforeseen circumstances beyond its control.
Likewise, PARC MONT-ROIG shall not be liable for theft, loss or damage to personal belongings left by the guest in the accommodation, which shall remain under the guest’s sole responsibility.

PARC MONT-ROIG, S.L. offers a holiday accommodation booking service that allows you to reserve the tourist accommodation available on our website. You may make your booking online through our website or request your booking by email or by telephone.
This document sets out the “GENERAL TERMS AND CONDITIONS” governing the operation of this website and the booking of tourist accommodation through www.parcmontroig.com, as well as the contractual conditions applicable to bookings requested by email or by telephone.

These GENERAL TERMS AND CONDITIONS have been drawn up in accordance with Article 10.1 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, Royal Legislative Decree 1/2007 of 16 November approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, Law 13/2002 of 21 June on Tourism in Catalonia, and Decree 75/2020 of 4 August on Tourism in Catalonia.

2. Purpose
The purpose of these GENERAL TERMS AND CONDITIONS is to inform users/customers about the terms and conditions of the booking services offered and, likewise, to inform them of the rights and obligations of the parties within the contractual relationship between PARC MONT-ROIG and the customer making the booking, hereinafter the “Customer”.
These GENERAL TERMS AND CONDITIONS shall apply to all bookings made through the website, by email or by telephone. Therefore, by making a booking, the Customer acknowledges having read these GENERAL TERMS AND CONDITIONS prior to making the booking and fully accepts them.
PARC MONT-ROIG reserves the right to unilaterally modify these GENERAL TERMS AND CONDITIONS at any time. However, the terms applicable to a booking shall be those accepted by the Customer at the time the booking is made.
These GENERAL TERMS AND CONDITIONS include the General Conditions of Use of the website and are complemented by the Privacy Policy and Cookie Policy.
3. Product and service
PARC MONT-ROIG acts as an intermediary on behalf and for the account of the owner of the tourist accommodation and, for the purposes of these GENERAL TERMS AND CONDITIONS, its activity is understood to consist of the rental of tourist accommodation on the Costa Dorada.
4. Access by users
Simple access to the website confers the status of user.
Use of the services offered on the website is free of charge for users and does not involve any commission or cost of any kind for access to the website, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by the user, which shall be borne by the user.
Access through third-party applications implies that security in access through such means is the responsibility of those entities. Likewise, the website declines any direct or indirect liability for system failures, website unavailability or any similar situation.
5. Rules of use of the website
Users shall be responsible for all content published by them and for its truthfulness. PARC MONT-ROIG reserves the right to verify all comments and/or opinions of users prior to their final publication on the website. Users shall be solely responsible for any false, inaccurate or outdated statements made and for any damages caused thereby to PARC MONT-ROIG or third parties as a consequence of failure to comply with this obligation.
Responsibility for comments published, directly or indirectly, on the website lies solely and exclusively with the user and PARC MONT-ROIG declines any liability as to their truthfulness.
By using this website, the user accepts that most communications with PARC MONT-ROIG will be made electronically, whether by email or notices posted on the website.
For contractual purposes, the user consents to the use of this electronic means of communication and acknowledges that all contracts, notices, information and other communications sent electronically by PARC MONT-ROIG comply with the legal requirement of being in writing. This condition shall not affect the rights granted to the user by law.
The user may send notifications and/or communicate with PARC MONT-ROIG through the contact details provided in these Conditions and, where applicable, through the contact areas on the website. Likewise, unless otherwise stipulated, PARC MONT-ROIG may contact and/or notify the user at the email address or postal address provided.
The user undertakes to make reasonable use of the services of the website and to comply with these GENERAL TERMS AND CONDITIONS, PARC MONT-ROIG reserving the right to restrict such use if it deems it appropriate.
The website is governed by Spanish law. PARC MONT-ROIG does not guarantee that the website complies with the laws of other countries, either wholly or partially, and declines any liability arising from such access.
It is strictly prohibited to use the name of PARC MONT-ROIG for professional or commercial purposes, directly or indirectly; to use the website for purposes other than renting tourist accommodation; to make false or fraudulent bookings; to publish offensive, sexist, racist, defamatory content or content contrary to the laws in force in Spain and the European Union; to defame, abuse, harass, threaten or infringe the legal rights of others; to use the website for promotional purposes not expressly authorised by the PARC MONT-ROIG team; to impersonate another person; to disseminate or request information promoting unlawful acts; or to make any fraudulent use of the website.
6. Intellectual and industrial property
The website is protected by intellectual and industrial property rights. By way of example and without limitation, this includes the contents, graphic design, source code, logos, texts, graphics, illustrations, photographs and other elements appearing on the website. Therefore, the user acknowledges that the reproduction, distribution, marketing, transformation and, in general, any form of exploitation, by any means, of all or part of the website constitutes an infringement of the intellectual and industrial property rights of PARC MONT-ROIG or of the holder thereof, unless prior express authorisation has been obtained.
Any use unrelated to PARC MONT-ROIG, including reproduction, modification, distribution, transmission, republication, arrangement or representation of any elements thereof, is strictly prohibited unless expressly authorised in writing by PARC MONT-ROIG.
The user may not modify or use such intellectual and industrial property in any way that its disclosure may be detrimental to PARC MONT-ROIG.
PARC MONT-ROIG shall claim damages arising from the improper use by third parties of its intellectual and industrial property.
PARC MONT-ROIG grants no licence or authorisation of use of any kind over its intellectual and industrial property rights or over any other rights or property related to the website, the services or the contents.
7. Notification of infringements
If a user infringes intellectual or industrial property rights or any other rights of third parties, PARC MONT-ROIG shall warn the user as soon as it becomes aware of such infringements so that the infringing content may cease to be published. In such case, the user shall be liable for such infringements.
If any person or entity considers that the contents published on the website infringe their rights to honour, privacy, image or any other right, they may notify PARC MONT-ROIG through any of the contact methods shown on the website, with the subject line “Infringement of rights”, request their removal and provide the information necessary to identify the allegedly infringed rights, the affected contents, their contact details, a statement of truthfulness and accuracy, and a copy of their ID card, passport or other proof of identity.
PARC MONT-ROIG shall review the request and, if it considers there are justified reasons for removal, shall proceed to the immediate deletion of such content from the website.
8. Contract conclusion and bookings
The Customer may formalise the booking of tourist accommodation with PARC MONT-ROIG in any of the languages in which these GENERAL TERMS AND CONDITIONS are available on the website.
8.1 Rates
Rates are indicated in euros (€) and shall be the price in force at the time the booking is made. A booking is understood as the rental of the selected tourist property for a limited period of time, in exchange for a determined price publicly displayed on the website. The rates shown on the website may be modified by PARC MONT-ROIG at any time, and the applicable rate shall be the one displayed on screen at the time the booking is made.
Prices include Value Added Tax (VAT), where applicable in accordance with the regulations in force on the date of the booking. Any change in the applicable VAT rate will automatically be reflected in the price of the services offered by PARC MONT-ROIG on the website.
The tourist tax applicable to accommodation establishments in Catalonia shall be added to the final booking amount according to the legal rate in force at any given time. At present, the applicable amount is €1.93 per person per day, for a maximum of 7 days, with minors under 16 years of age being exempt.
8.2 Booking procedure
The Customer may select an accommodation from the different categories offered by PARC MONT-ROIG.
The Customer must select the check-in and check-out dates. The indicated check-out date refers to the day on which the accommodation is vacated, and the night corresponding to that date is not included.
The Customer must select the number of adults and/or children who will occupy the selected accommodation.
In accordance with the applicable regulations, prior to entering into the contract the Customer shall be able to view the essential characteristics of the accommodation and services, as well as the information and photographs of the accommodation of interest.
At the final step, all booking details and the total price including taxes will be displayed, and the Customer may choose the payment method, either bank card or bank transfer. In both cases, the payment indicated on screen must be made as a deposit or confirmation payment. The remaining balance must be paid on the day of arrival at the office, by credit card or cash.
If bank card payment is selected, the indicated amount will be charged automatically. If bank transfer is selected, it must be made within 3 days. Otherwise, PARC MONT-ROIG reserves the right to cancel the pre-booking. The bank details required to make the transfer will be provided to the Customer by email.
From the moment the Customer confirms the booking by clicking on the “BOOK” icon, it shall be deemed that the Customer has knowingly accepted the content and conditions of the booking and, in particular, the fact that the booking entails an obligation to pay, as well as the prices, characteristics and quantities relating to the contracted services.
Once the booking process has been completed and the corresponding payment made, the Customer will receive a booking confirmation email. This email will also include a summary of the booking information.
Without prejudice to bookings already made by Customers, PARC MONT-ROIG may modify the range of services offered on the website at any time.
For any questions regarding the contracted services or requests for assistance, the Customer may contact Customer Service at info@parcmontroig.com.
PARC MONT-ROIG assumes no liability in the event of an error in entering the email address or failure to receive the booking confirmation email where this is not attributable to PARC MONT-ROIG.
Once the booking process has been completed, the Customer shall be entitled to receive the corresponding invoice. The issuance of an electronic invoice shall be subject to the prior express consent of the Customer during the booking process, and such consent may be withdrawn at any time by sending an email to pd@parcmontroig.com.
8.3 Security deposit
PARC MONT-ROIG may request a security deposit by means of a pre-authorisation on a valid credit card, in order to cover possible damages, breaches of the stay conditions or additional costs attributable to the Customer during the stay. After the Customer’s departure, and once the condition of the accommodation has been checked, the pre-authorisation will be released, unless total or partial execution thereof is required for the above-mentioned reasons.
9. Payment
9.1 Payment methods
The payment methods available for contracting services through the website are bank card and bank transfer. The accepted bank cards on the PARC MONT-ROIG website are Visa and MasterCard.
Credit cards are subject to checks and authorisation by the issuing bank. If such entity does not authorise payment, PARC MONT-ROIG shall not be able to formalise any contract with the Customer.
9.2 Payment terms
All bookings must be paid in euros, including all mandatory taxes and charges. Bank fees, where applicable, shall be borne by the Customer.
The remaining balance of the booking must be paid on the day of arrival at the PARC MONT-ROIG office, by credit card or cash.
9.3 Security of payment transactions
In order to guarantee the security of payments made by bank card, the Customer may be required to provide the card security code appearing on the reverse of the card, where necessary for processing the payment under the system used.
In the context of combating internet fraud, data relating to the Customer’s booking may be communicated to third parties authorised by law or designated by PARC MONT-ROIG, solely for the purpose of verifying the identity of the Customer and the validity of the booking, the payment method used and the provision of the contracted service.
Once this check has been completed, PARC MONT-ROIG reserves the right to request a photocopy of the Customer’s identity document and/or any other data relating to the Customer’s identity. The Customer has the rights granted by data protection regulations as provided in the Privacy Policy.
PARC MONT-ROIG uses all means available to it to guarantee the confidentiality and security of payment data transmitted by the Customer during transactions made through the website. To this end, the website uses a secure SSL payment system.
10. Arrivals (check-in) and departures (check-out)
10.1 Check-in
Check-in must be completed online, through the link provided in the booking confirmation email, where the personal details of all occupants of the accommodation must be supplied no later than 1 day before the arrival date.
10.2 Key collection
The keys to the booked accommodation will be made available to the Customer at our office located at:

If arrival is after 19:00, the Customer must contact PARC MONT-ROIG in advance, by telephone or email, in order to arrange key collection through a coded security box located next to the entrance door of our office. Key collection outside the established hours must be previously authorised by PARC MONT-ROIG and may incur a supplement of up to €50.
10.3 Check-out
The expected departure time is from 09:00 to 10:00.
Keys must be returned to our office located at Urbanización Parque de Mont-roig, Avda. de la Costa Ibérica, 8, 43892 Mont-roig del Camp (Tarragona).
If departure takes place before 09:00, the keys may be deposited in the mailbox located next to the office door.
11. Right of withdrawal
According to Article 103 of Royal Legislative Decree 1/2007 of 16 November, the right of withdrawal shall not apply to contracts concerning the supply of accommodation services for purposes other than residential use, where the contracts provide for a specific date or period of performance.
Therefore, the Customer is informed that the legal right of withdrawal does not apply.
12. Cancellation and modification policy
Although the legal right of withdrawal does not apply to accommodation services other than those intended for residential use, if the Customer wishes to cancel the booking, this may be done by emailing info@parcmontroig.com.
12.1 Cancellation of apartment and holiday house bookings
If cancellation is made up to 15 days before the arrival date, the Customer shall be entitled to a refund of the amount paid, deducting €25 as administration fees.
If cancellation is made less than 15 days before the arrival date, the amount paid as a deposit shall be retained as cancellation fees.
12.2 Cancellation of villa bookings
If cancellation is made up to 30 days before the arrival date, the Customer shall be entitled to a refund of the amount paid, deducting €35 as administration fees.
If cancellation is made less than 30 days before the arrival date, the amount paid as a deposit shall be retained as cancellation fees.
12.3 Refund of amounts
Where a refund is due to the Customer after the deductions indicated above, PARC MONT-ROIG shall reimburse the amount owed as soon as possible and, in any case, within a maximum of 14 days.
12.4 Booking modification
A booking modification may be requested up to 30 days before the arrival date, provided that the modification is possible and approved by PARC MONT-ROIG. If approved, a supplement of €25 will be charged as an administration fee. Modifications are subject to availability and, where applicable, to the corresponding price adjustment according to the rates in force at the time of the modification.
If the Customer wishes to modify the booking, this may be requested by emailing info@parcmontroig.com.
13. Modification or cancellation of the booking by PARC MONT-ROIG
In the event of a supervening impossibility of making the reserved accommodation available to the Customer for reasons not attributable to the Customer, PARC MONT-ROIG may offer alternative accommodation of similar characteristics. If this is not possible, or if the alternative accommodation cannot reasonably be accepted, the amounts paid shall be refunded in full.
14. Guarantees
In accordance with the applicable regulations, PARC MONT-ROIG is obliged to provide services that conform to the contract, being liable for any lack of conformity existing at the time the keys are handed over.
In order to conform to the contract, the service must correspond to the description provided by PARC MONT-ROIG and possess the qualities presented through the website, offer the quality and performance usual for a service of the same type that the consumer may reasonably expect in view of its nature, and possess the characteristics agreed between the parties or be suitable for any specific purpose intended by the Customer and made known to and accepted by PARC MONT-ROIG.
For any claim relating to legal guarantees, the Customer must contact Customer Service through the means specified in these GENERAL TERMS AND CONDITIONS.
15. Included services and booking requirements
15.1 Included services
The booking includes the delivery of the reserved accommodation for temporary use for holiday, tourist or recreational purposes during the contracted period, as well as the services indicated in the booking confirmation, such as bed linen, towels and final cleaning of the accommodation.
The property is delivered furnished, equipped for everyday use and in suitable conditions of cleanliness, maintenance and proper functioning.

15.2 Services not included
The information provided for each accommodation on the website shall indicate, where applicable, services not included and available extra services.
15.3 Mandatory services
The Customer is informed that bed linen, towels and final cleaning are part of the included services where this is stated in the booking confirmation.
15.4 Booking requirements
Occupancy exceeding the maximum capacity indicated shall not be allowed unless expressly authorised by PARC MONT-ROIG. If the number of persons indicated in the booking is exceeded, PARC MONT-ROIG may cancel the booking and order the immediate eviction of the accommodation.

16. Duties and obligations of the Customer
Without prejudice to the other responsibilities established in these GENERAL TERMS AND CONDITIONS, the Customer must take the following into account.
The reservation holder shall be responsible for compliance with these rules by all occupants of the accommodation and shall be liable for any damage caused during the stay, which must be reported immediately to PARC MONT-ROIG.
Tourist users have the duty to comply with the conditions agreed in these GENERAL TERMS AND CONDITIONS, to pay the price of the contracted tourist services in the agreed place, manner and time, to respect the rules of use and the regulations of each community, as well as the general rules of coexistence and hygiene, insofar as these are not contrary to the applicable law, to respect the facilities, goods and services made available by PARC MONT-ROIG, and to respect the environmental, cultural and other values of the tourist resources they use or visit.
The Customer and the occupants must avoid making noise that may disturb neighbours, especially during rest hours, respect the rules governing the use of swimming pools, gardens and common areas, dispose of rubbish in plastic bags in the municipal containers located in the street, and not leave bicycles, prams or other objects in common areas.
Water and electricity must be used responsibly and in accordance with normal use of the accommodation. Proper use of the included utilities is required in order to avoid excessive consumption.
Minors must remain under the supervision and responsibility of an adult at all times.
The internal regulations of the accommodation, as well as the rules of the owners’ community in which the property is located, are mandatory for all guests. Failure to comply with these rules, especially where this results in a disturbance of coexistence, breach of use regulations or hygiene conditions, may lead to the total or partial retention of the security deposit and, in serious cases, to the immediate cancellation of the booking and eviction from the accommodation, in accordance with Article 39 bis of Law 13/2002 of 21 June on Tourism in Catalonia.
PARC MONT-ROIG may prevent users from remaining in its accommodations if they fail to comply with any of the duties established in these Conditions or in the applicable coexistence regulations.
17. Responsibility and security of transactions
PARC MONT-ROIG guarantees the correct application of security and control measures regarding the processing of personal data supplied and necessary for online transactions. The use of identifiers, passwords or other validation elements is intended to verify the identity of the Customer and may be required during booking validation. The communication of the bank card number and the definitive validation of the booking shall serve as proof of acceptance of the booking and of the enforceability of the amounts committed for the booking made. Computer records stored in the computer systems of PARC MONT-ROIG and its partners shall be considered proof of communications, bookings and payments made between the parties.
Specifically, the Customer is responsible for maintaining the security of online transactions and, where applicable, of passwords or access credentials. Therefore, PARC MONT-ROIG shall in no event assume any liability for the fraudulent use of such data where this is not attributable to PARC MONT-ROIG.

19. Liability
19.1 Legal capacity to contract
Before making a booking, the Customer declares that he or she has full legal capacity, that is, is over 18 years of age, to be bound by these GENERAL TERMS AND CONDITIONS. Consequently, if a person lacking legal capacity makes a booking of tourist accommodation through the website, his or her legal representatives shall assume full responsibility for such booking and, in particular, must pay the corresponding amount.
19.2 Limitation of liability
Unless otherwise provided by law, PARC MONT-ROIG shall not accept liability for losses not attributable to any breach on its part, business losses including loss of profit, loss of income, contracts, anticipated savings, data, goodwill or unnecessary expenses incurred, or any other indirect loss not reasonably foreseeable by both parties at the time the contract was concluded.
Likewise, PARC MONT-ROIG limits its liability with respect to minor differences or inaccuracies that may exist in the display of accommodations or services due to screen resolution, browser issues or other technical factors; to technical failures preventing the normal operation of the internet service; to website unavailability due to maintenance or other reasons; to misuse of the website or fraudulent acts based on the information provided on it; and to possible security errors, disconnections or damage that may be caused to the user’s computer system for reasons beyond PARC MONT-ROIG’s control.
PARC MONT-ROIG shall not be liable for incidents, negligence or services attributable to third parties, nor for force majeure situations or unforeseen circumstances beyond its control. Likewise, PARC MONT-ROIG shall not be liable for theft, loss or damage to the personal belongings left by the Customer in the accommodation, which shall remain under the Customer’s sole responsibility.
In general, PARC MONT-ROIG shall not be liable for any failure or delay in performing any of its obligations where such failure or delay is due to events beyond its reasonable control, that is, force majeure. Such cases shall include, by way of example, strikes, lockouts or other industrial action, civil commotion, riot, invasion, terrorist threat or attack, war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster, impossibility of using transport, impossibility of using public or private telecommunications systems, and acts, decrees, legislation, regulations or restrictions of any government or public authority.
Obligations shall be suspended for the period during which the force majeure event continues, and PARC MONT-ROIG shall have an extension of time to perform its obligations equal to the duration of such event. PARC MONT-ROIG shall use all reasonable means to find a solution allowing it to comply with its obligations despite the force majeure event.
20. Liability and limitation of liability for links from other websites
A user who wishes to offer contents from the PARC MONT-ROIG website on their own website may include a link connecting their website to the home page of the PARC MONT-ROIG website.
Websites offering a link to the PARC MONT-ROIG website may use the PARC MONT-ROIG trademark, logo, trade name and/or any other distinctive sign only in cases legally authorised or expressly permitted by PARC MONT-ROIG.

The website may host advertising content. Advertisers shall be solely responsible for ensuring that the material submitted for inclusion on the website complies with the laws applicable in each case. PARC MONT-ROIG shall not be responsible for any error, inaccuracy or irregularity contained in advertising content or sponsorship material.

PARC MONT-ROIG shall process all information entered on the website in accordance with its Privacy Policy and in compliance with the EU General Data Protection Regulation 2016/679 and Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights, as data controller of the information included on the website.

If any deficiency or incident is detected in the accommodation, the Customer must report it immediately during the stay by email. PARC MONT-ROIG will make every effort to resolve any incident as quickly as possible.
In order to be properly dealt with, incidents must be reported during the stay and as soon as they are detected. Subsequent claims regarding incidents not reported during the stay will not be considered, unless by their nature they could not reasonably have been detected at that time.
The Customer may submit complaints or claims to PARC MONT-ROIG through the contact details provided at the beginning of these Conditions.
PARC MONT-ROIG shall respond to complaints received as soon as possible and, in any case, within a maximum period of one month from the submission of the complaint.
In addition, PARC MONT-ROIG has official complaint forms available to consumers and users, which may be requested through the contact details provided at the beginning of these Conditions or via the contact form on the website.
25. Miscellaneous
25.1 Partial invalidity
If one or more provisions of these GENERAL TERMS AND CONDITIONS are considered invalid or declared invalid by virtue of any law, regulation or final decision of a competent authority, the remaining provisions shall remain fully valid and effective.
25.2 Waiver exclusion
The fact that either party does not exercise the rights to which it is entitled in the event of breach by the other party of any of the obligations imposed by these GENERAL TERMS AND CONDITIONS shall not be interpreted as a waiver of the right to enforce such obligation in the future.
25.3 Applicable law and jurisdiction
These general conditions are governed by Spanish law. The parties submit, at their option, for the resolution of disputes and waiving any other jurisdiction, to the courts and tribunals of the consumer’s domicile or, where applicable, to the place of performance of the obligation.
25.4 Validity
These GENERAL TERMS AND CONDITIONS shall remain in force until the termination of the contract between the parties and the extinction of all obligations assumed by each of them.
These Conditions may be modified, and it is therefore the Customer’s responsibility to consult them periodically and especially when making a booking, since the Conditions in force at that time shall be those applicable.
